Responsibilities:

The Law Department is seeking a highly talented attorney to sit within the Claim Division and support the Associate General Counsel, Manager of Claims. The right candidate will be expert in contractual indemnification and insurance pass through language, contract interpretation, contract enforcement, litigation management, insurance compliance, coverage review, policy analysis and claim resolution. These skills will be deployed in the context of our management of the Port Authority of NY and NJ's self-insured and captured liability risk.

Specific responsibilities include, but are not limited to:

  • Pursue significant claims against parties who owe the Port Authority protection under contract including third-party contractors, subcontractors, developers, tenants, customers, trespassers, or invitees who damage Port properties and/or other interests under law. The substance of these claims will be varied and could arise from design-error, negligence, breach of contract or generalized cost overrun. Advise our Facilities and Departments in gathering and understanding the necessary evidence and statements to pursue the claim. Preserve all evidence through formal notices to the relevant parties, external or internal. Develop, argue and issue written claim demands bringing the matter to conclusion through settlement or Arbitration.
  • Maintain responsibility for monitoring and supervising the progress of a set of significant or important cases that are assigned to outside counsel. Develop and enforce guidelines for outside counsel both the ensure quality legal work and maximize efficient representation.
  • Monitor and supervise outside counsel respecting the litigation plan. Assist our claim representatives in any discovery decisions that need to be made and coordinated with outside counsel. Document the file and provide appropriate early warning for any necessary reserve movements, significant case milestones and to ensure compliance.
  • Assist the claim manager in demanding and pursing any available coverage whether it is available through our own Policies or those purchased by third parties who are obliged to protect the Port Authority and PATH. Review and organize legal research to support any complex coverage arguments. Direct the necessary Facility and or Department representatives to ensure that the damage or loss is documented correctly. Coordinate with any internal efforts to recoup loss through alternate funding such as FEMA or other Federal or State funding opportunities.
  • Review and assist the claim manager in maintaining best practice in audit and compliance obligations that are handled by Claims. This may include the development and implementation of training for the Claim Division.
  • Review, analyze and advise claims management on relevant union contracts especially concerning the distinct and varied rights that different levels of PATH employees claim by contract but assert within the context of the Federal Employee Liability Act.
  • Develop training and regimen for the PATH claim team and OMS on any issues arising from the intersection of union contract obligations, FELA, HIPAA and employer obligations.
  • Assist the claim manager in project work in support of the Claim Divisions continued development and support of Litigation.

Qualifications:

Candidates must present the following qualifications to be considered eligible for this position:

  • J.D. from an accredited institution
  • At least 3 years' experience in claims adjustment, similar litigation work or related property/casualty field, with a strong preference for experience with companies engaged in complex claims or litigation or large infrastructure construction/management.
  • Proven experience in the management and oversight of claims programs, practices and legislation.
  • Understanding of special requirements of governmental agencies, union driven representation, self-insured entity compliance, HIPPA and the Federal Employee Liability Act (FELA).
  • Excellent written and oral communication skills (as well as the ability to present to a variety of audiences), including demonstrated experience establishing, interacting and fostering working relationships with a multitude of constituents and stakeholders.
  • Computer literacy and experience in opening and tracking matters online.
  • Ability to work in a fast-paced, collaborative office environment, with demonstrated flexibility and resourcefulness in analyzing and resolving a wide-range of complex and novel matters, including those of a sensitive nature with monetary exposure.
